Terms and License

This agreement

These terms are between you and [Your name or company] (“we”, “us”), the maker of NightJar. They apply when you download, install or use NightJar, free or Pro. If you use NightJar for an organization, you accept them for that organization.

Polar Software, Inc. sells NightJar Pro as merchant of record. Polar’s Buyer Terms cover the payment itself. These terms cover the software, and they are the “Supplier Agreement” those Buyer Terms refer to.

Your license

NightJar Lite

We give you a free, non-exclusive, non-transferable license to use NightJar for personal and commercial work. It covers up to 3 apps and the four default themes.

NightJar Pro

Pro is a one-time purchase, not a subscription. Your license key unlocks unlimited apps, all themes, and Siri shortcuts on macOS. The key is for one person. You can activate it on as many computers as the activation limit on your key allows. To move it, remove the key in Settings (or in your Polar customer portal) and activate it on the new computer.

What you may not do

• share, publish or resell license keys
• bypass, disable or tamper with the license check
• redistribute NightJar with Pro unlocked

These limits apply except where the law gives you rights we cannot restrict.

Refunds

If Pro is not for you, ask for a refund within [30] days of purchase, through your Polar receipt or by emailing [contact email]. Consumer protection laws in your country may give you further rights, and nothing here limits them.

A refund or chargeback revokes the key. NightJar returns to Lite the next time it checks the key. The apps you configured stay, and you can still edit and run them, but you cannot add more than the Lite limit.

License checks

The app checks your key with Polar when you activate it, then at most every 14 days. A failed check, because you are offline or Polar is down, never removes Pro. Only a key that Polar reports as revoked or disabled does. The Privacy Policy lists what these checks send.

What NightJar does on your computer

NightJar runs the commands you configure, with your user account’s permissions. It stops processes by signalling their whole process group, or on Windows their whole process tree. It can also end processes you did not start with it:

• when you kill a port, a process group, or everything listed in the ports panel
• when “Free the port before starting” is on (the default), NightJar ends a leftover non-system process holding the port your process needs
• on launch (macOS and Linux), NightJar ends processes that a previous NightJar session started and left behind after a crash

Any unsaved work in a process that is stopped or killed is lost. You are responsible for the commands you configure and for the processes you choose to kill. NightJar’s control server listens only on 127.0.0.1 and can run commands. Do not expose it to a network.

Updates

We may release updates, but we are not required to. Updates may change or remove features. We will not take away Pro features you paid for from the version you already have.

No warranty

NightJar is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise it will be error-free or uninterrupted, or that it will work with every tool, shell or project.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data, lost work or lost profits, arising from your use of NightJar. Our total liability for any claim is limited to the amount you paid for NightJar in the 12 months before the claim, or $0 if you use NightJar Lite. Some places do not allow these limits. There, they apply only as far as the law permits.

Ending this agreement

You can stop using NightJar at any time. If you break these terms, your license ends and you must stop using the software. Clauses 7, 8 and 11 survive the end of this agreement.

Third-party software

NightJar is built on Electron and other open-source components. They are licensed under their own terms, which come with the app.

Governing law

These terms are governed by the laws of [country or state]. This does not remove the protection of the mandatory consumer laws where you live.

Changes to these terms

If these terms change, we update this page and the date at the top. The terms in effect when you bought Pro keep applying to that purchase unless you agree to new ones.
